Colonial Title has been conducting title searches for clients in the Tulsa area as well as throughout the state of Oklahoma for years. We understand that the title examination is the most important phase of a real estate transaction. This ensures that the title is marketable so that the buyer and lender know the property can be conveyed free and clear of any lien, judgments or other encumbrance. Title defects can arise from a number of different sources including unpaid taxes or Deeds of trust (mortgages), tax liens, judgments or mechanic's liens, and more.

In addition to these sorts of liens or encumbrances, there may be defects in the actual deeds found in the chain of title. An heir may have failed to execute a deed or the property description may not be adequate for a valid conveyance under state law. We will "run a chain of title" and examine in reverse chronological order the names of all the persons who have owned the land for a certain time period to verify ownership and uncover flaws. When examining the chain of title for defects, we also look for easements, covenants and restriction or rights or way and their like that may affect the marketability of title.

Once the chain of title and conveyances have been reviewed, we will examine other public records for title defects such as UCC Financing Statements and civil judgments. After all of these steps have been taken, we will prepare a Preliminary Opinion on title and inform our clients so that the buyer and lender can determine the marketability of title and whether to proceed with the transaction.  At Colonial Title, we know that a diligent and thorough examination is an essential part of any real estate transaction.
